Our goal is to reduce or eliminate the 1989 Metro Bond Property Tax in The Meadows, which is 1/3 of everyone’s cost, and is expected to continue for another 50+ years. If someone wants to be on update email distribution list, send an email to Jim Garcia at MeadowsMetro@gmail.com.

Here is an update of where things stand with Metro Bond Tax in The Meadows Castle Rock.

  • The law team at Burg Simpson (BS), which was originally hired to represent Metro District 1 has expanded to now represent all districts and all property owners in The Meadows. Engagement contracts have been signed by Districts 2 & 7. Districts 1,2,&7 retain all of the debt for the 7 Districts. The Boards worked collectively to re-allocate budgeted money to fund this item. The Boards met earlier this year and approved joining District 1.
  • BS has narrowed their focus on the legitimacy of the bonds. i.e., Was the revised legal filing in December 1993 from a new agreement with Castle Rock and the developer in October 1993 proper, Do the terms of the revised bonds comply with Colorado law, Is it legal to collect this tax for 80+ years, Was there proper voter authorization from the property owners to change the 1989 bonds in 1993, Are the bonds legitimate under Colorado TABOR laws (Taxpayer Bill of Rights).

TABOR law was passed in in 1992. Our original bonds were issued in 1989. The revised bonds were issued in 1993. In order to change a bond and tax on a property in Colorado, property owners must approve the change by a majority of voter approval.

  • BS expects to have a final opinion(s) to present to all boards in a closed executive session in the next 30-90 days. If/when there is an agreement with the boards to move forward, we will publish their report and have a community meeting to explain the details for everyone to attend.
  • We are NOT having any conversations with anyone about modifying, restructuring, refinancing, changing the Mill rate, special assessments, etc. in any manner, whatsoever!

All of these items have been proposed and completely rejected. There will never be any special assessment or add-on taxes. Our Mill Levy tax rate is fixed at 35 Mills and will NEVER increase above that rate which is low. Sterling Ranch, for example, has a metro bond tax rate of 95.522, almost 3 times our rate. Founders Village is 94.563. There are many incorrect facts being circulated with this item. PLEASE help settle this wrong information. For the first time since The Meadows began, the property owners have banded together to take control away from the developer to understand why we should pay $1b in property taxes for a $57m private development project.

  • District 4 – The Master District which controls most of the tax revenue for the entire Meadows – Developer has agreed to resign and turn control over to the 147 property owners in this area, just south of Aspen View Academy. They have agreed to pay all costs, legal and other for this transfer. Any property owner will be able to “opt in” their property and then be eligible to be a board member in District 4. Developer is working on the details. This is not operational to-date, but they are working on it. Property owners can expect more information on this topic in the next few months.

History: In 2007 the developer filed a motion to exclude all properties (and the property owners) in District 4 from being eligible to serve on that Metro Board. That motion ensured the Developer would control District 4, which controls (basically) all of the incoming Meadows tax revenue in perpetuity. Developer subsequently sold 70% of The Meadows bonds to Colorado Bond Shares (CBS) shortly thereafter in 2007. In 2019, CBS purchased the remaining 30% of the bonds.

After repeated requests, CBS has not provided us with any bond information including due diligence documents when they evaluated and purchased of our bonds. They remain silent. We have not had any notable conversations with them.

  • District 5 – Commercial District – Developer has resigned. We have four residential board members controlling that board. We need one member to replace the developer’s position – a business owner, resident, or someone who owns personal property in this district to join the board (and volunteer as President, if needed).If you want to help and are eligible, please contact Jim Garcia – JimGarcia100@gmail.com.

 

  • After numerous attempts for in-person meetings, CBS and Spencer Fane (SF) have not agreed to meet with BS.
  • After years of requests for production of documents, we have received enough information to form legal opinions, but have not received everything requested. Metro Boards are moving forward.
  • $1m+ Meadows Lifestyle Improvement Lottery Funds Money – The boards are putting together a collective task force on how to best spend this money. We have many ideas and are still asking for your help and project ideas. Contact Paul Brookshire brookshire@gmail.com.
  • Meadows Median Landscaping – After extensive meetings about design, budget, water lines & usage, grass removal credits, landscaping bids, plant & rock choice, permitting, installation details, etc., this upgrade should begin soon. This is not an HOA item. It is a developer, (now) Metro Board resident item. Using existing re-allocated tax revenue, these upgraded common areas should be a big improvement for our community. We are working on re-allocating more money to continue improvements. A big shout out goes to Larry Messer – larrymesser@meadows7.com, who has volunteered a lot of his personal time to coordinate this entire project.
  • Updated numbers from Officer Seth Morrisey with Castle Rock Police for the Flock Security Cameras in The Meadows paid by the Metro Bond Districts through June 2026.  Grand total, 212 stolen vehicles, license plates, or vehicles on the police department “hit list” have been apprehended due to the Meadows Flock Cameras since the program was initiated.  Statistically 85% of all crimes are committed with a stolen vehicle.  With the Meadows sandwiched between I-25 and Hwy 85 the value of these cameras is immeasurable.
